Next lecture on 30 May - Reading material
Dear students,
Next week there will be no lecture as I will be organising hosting a 2-day workshop on energy law in Hasselt.
Our next course is thus planned for Thursday 30 May 2024, and it will probably be online, but a newer announcement will follow in due time. In between, you can have some more time to work on your presentations and essays, and you can of course send me an email with draft plans or texts, or questions that you might have.
In any case, our next course will be on the concept of circular economy and on the Waste Framework Directive. For your preparation for the lecture, I have uploaded on eclass the following readings that you are encourage to read:
Waste Framework Directive 2008/98/EC (consolidated version)
Chris Backes, “The Waste Framework Directive and the Circular Economy” in Marjan Peeters and Mariolina Eliantonio (eds), Research Handbook on EU Environmental Law (Edward Elgar 2020). I would encourage you to start with this chapter, as it provides a concise presentation and analysis of the issues that we will discuss.
Joonas Alaranta and Topi Turunen, "How to Reach a Safe Circular Economy? — Perspectives on Reconciling the Waste, Product and Chemicals Regulation' [2020] Journal of Environmental Law 113. The authors provide a good description of the concept of circular economy and delineate legal and regulatory challenges that the attainment of the relevant transition faces.
You are also warmly invited to read the judgement in a) the case C-188/07, Commune dr Mesquer, a landmark judgement for the application of the Waste Framework Directive, especially when it come sto liability questions: https://curia.europa.eu/juris/liste.jsf?language=en&num=C-188/07; b) C-624/17, Tronex, a more recent case that deals with the issue of the cross-border movement of waste: https://curia.europa.eu/juris/liste.jsf?language=en&num=C-624/17.
